INTRODUCING THE 2017 DEATHWORKZ CHAOTIC COSTUME CONTEST

We couldn’t throw a Halloween festival without a Costume Contest right?! Riiiiiiight??  Winners from THREE lucky categories will receive VIP Passes to the Deathworkz Haunt Halloween Festival!

The 2017 Deathworkz Chaotic Costume Contest entry period begins at 12:00:00 p.m. Pacific Standard Time (PST) on Monday September 18th, 2017 and ends at 12:00:00 p.m. PST on Monday, October 16th 2017.... which gives you time to think about your Chaotic Costume, rally your friends and WIN!

This year we’re allowing participants to enter one of three categories.  The entry that gets the most votes in each category wins, so gather your squad and spread the word about your favorite submission! One vote per verified email only.

The Categories:

FEMALE – These submissions must be a brand new costume/pic (no recycling older entries) and the participant MUST be in the picture.
MALE – These submissions must be a brand new costume/pic (no recycling older entries) and the participant MUST be in the picture.
SQUAD – These submissions must contain no more than four people, must be a brand new costume/pic (no recycling older entries) and ALL the participants MUST be in the picture.


2017 DEATHWORKZ CHAOTIC COSTUME CONTEST OFFICIAL CONTEST RULES

No purchase necessary to enter or win. Void where prohibited by law. Purchase will not increase your chances of winning.

  1. KEY DATES

The 2017 Deathworkz Chaotic Costume Contest (the “Contest”) entry period begins at 12:00:00 p.m. Central Standard Time (PST) on Monday September 18th, 2017 and ends at 12:00:00 p.m. PST on Monday, October 16th 2017 (the “Entry Period”). Entries received before or outside of the Entry Period will not be accepted or be eligible to win the stated prizes, except as otherwise set forth in these Official Contest Rules (these “Terms”). The fan-voting period will begin on at 12:00:00 p.m. PST on Monday September 18th, 2017 and ends at 12:00:00 p.m. PST on Monday, October 16th 2017 (“Fan Voting Period”). Sponsor’s clock is the official clock of the Contest.

  1. ELIGIBILITY

The Contest is open only to participants eighteen (18) years of age or older at the time of entry who are legal residents of the 50 United States and the District of Columbia, excluding residents of Alaska and Hawaii. To be eligible, participants must also have a Facebook account. You may sign up for a Facebook account for free. Employees, agents, officers, and directors of Deathworkz LLC (“Sponsor”) and its respective parents, subsidiaries and affiliated companies, advertising, promotion or production agencies, prize providers, and their immediate family members or individuals residing in their same household, are not eligible to participate or enter the Contest. Participants agree to be bound by all decisions of Sponsor, which are binding and final.  Void in Puerto Rico, U.S. territories and possessions and wherever prohibited or restricted by law.

  1. HOW IT WORKS

During the Entry Period, participants must register at the Deathworkz site (the “Site”). Fill in your ENTIRE profile including your full Facebook Profile link. Follow the registration instructions.  Once your registration is complete, click on the Contests tab in the Top Menu, then select the folder (Male Contestant, Female Contestant or Squad) that you will be adding your entry in.  You will see an upload tab below.  If you do not see an upload tab, you have not completed your registration.  Select the photo you wish to submit as your entry, jpgs only.  Please name the photo with the same username you used on your registration.  In the description box, please enter the following:  The Male, Female and Squad category submissions must include the participant(s) in the Submission.  No video submissions, links, or other formats or types of files will be accepted.  All Submissions must follow the Submission Guidelines set forth below. Submissions may or may not be acknowledged, in Sponsor’s sole discretion. Sponsor is not responsible for Submission complications, technical difficulties or unregistered or unrecorded Submissions. Profane or inappropriate usernames will result in disqualification.  Complying with Sponsor’s instructions and these Terms will generate one (1) entry into the Contest. Any participant who enters after the close of the Entry Period, or who submits a Submission that is not in compliance with these Terms, will not be given an entry into the Contest.  Limit: Each participant may obtain only one (1) entry into the Contest. A participant may not enter more than one submission to win more than one of the categories and prizes. Any attempt by participant to obtain more than the stated number of entries by using multiple or different email accounts, identities, registrations and logins, or any other methods will void that participant’s entry and that participant may be disqualified from the entire Contest in the sole discretion of Sponsor.

  1. SUBMISSION GUIDELINES

Only Submissions that meet the Submission Guidelines set forth below will be considered a Submission. The Male and Female categories submissions must include the participant in the Submission. The Squad category submissions must include all 4 participants in the Submission.  In order to be eligible for this Contest, your Submission may not (as determined in the sole discretion of Sponsor):

  •  Contain a sample or music or sound clip owned by another individual unless the required permissions have been obtained;
  •  Contain any false or misleading statements on the entry form or plagiarize, replicate, or copy any other submitted Submission;
  •  Be sexually explicit, obscene, profane, or offensive;
  •  Be derogatory of any ethnic, racial, gender, religious, professional or age group;
  •  Promote alcohol, illegal drugs, tobacco, firearms, or weapons of any kind (or the use of any of the foregoing);
  •  Promote any activities that may appear unsafe or dangerous;
  •  Endorse any form of hate or hate group;
  •  Include any persons living or dead that do not wish to be included in the picture. I.E: if someone is in the picture you submitted and does not want to be included, we will have to disqualify your submission. So make sure everyone is ok with being in the picture.
  •  Communicate messages inconsistent with the positive images and/or good will to which Sponsor wishes to associate;
  •  Contain a virus, Trojan horse, spyware, adware, malware, bot, time bomb, worm, or other harmful or malicious component;
  •  Violate any law.

All Submissions that do not comply with these Terms or that otherwise contain prohibited, or inappropriate content deemed unacceptable by the Sponsor, in its sole discretion, will be disqualified and will not be published. The Sponsor makes the final determination as to which Submissions are eligible to take part in this Contest. Sponsor reserves the right to modify the criteria, dates, and guidelines of the Contest at any time.

  1. SELECTION AND NOTIFICATION OF WINNERS

At the start of the Entry Period, the Fan Voting Period will also begin where the public can vote on their favorite submission. Voting will be done on the Site via a ‘rating system’. Each person may vote per verified email.  If anyone is caught using multiple emails, their accounts will be deleted and the votes nullified. The use of automated software for voting is strictly prohibited and may result in your disqualification from the Contest. Sponsor, in its sole discretion, reserves the right to exclude any vote(s) that may not comply with the minimum voting requirements set forth herein. At the end of the Fan Voting Period, the Submissions with the highest rating will be deemed the Contest winners (each a “Winner” and collectively, the “Winners”), subject to confirmation of eligibility and compliance with these Terms. If there is a tie for the Winners, then Sponsor may (i) choose to include, at its sole discretion, all the tying Winners or (ii) have one of the Judges (as defined below) review the entries tied the last Winner based on criteria below in order to break the tie. At the close of the Fan Voting Period, a qualified panel of judges (“Judges”), as determined by Sponsor in its sole discretion, will review the Winners from each category and confirm them as the three (3) Winners. In the case of a voting tie, if the judges elect to, they will break the tie based on the following criteria (“Judging Criteria”):

  •  Quality of costume (1/3)
  •  Creativity of costume (1/3)
  •  Overall personal effort put into submission [DIY gets more points than if purchased at a store] (1/3)

On or around Monday, October 16th, 2017 the two (2) potential single winners and one (1) potential squad winner with the highest scores, and potentially the Judging Criteria in the case of a tie, will be notified at the contact information provided on their entry form; there will be three (3) Prize Winners. In the event of a tie, if the judges elect to break the tie, the Submission with the highest score in the Quality of Costume category will be deemed the potential winner of the applicable prize. In the event that there is still a tie, the Sponsor will have an alternate judge review and judge the tied Submissions to break the tie. Sponsor reserves the right to not select a winner for any or all prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions. If a potential winner fails to comply with any of these Terms or is found to be ineligible or unqualified for any other reason or to have tampered or interfered with the voting process, the potential winner may be disqualified.

Each participant may be required to complete and return to Sponsor an Affidavit of Eligibility/Release of Liability, and, if legally permissible, a Publicity Release (collectively, the “Releases”) within the time period specified by Sponsor. In addition, potential winners may be required to certify, on information or belief, that their Submission is their original creation and has not been (i) published or (ii) publicized and (iii) has not won another contest. If a potential winner fails to complete and return any required Releases within the specified time period, that potential winner may be disqualified and an alternate winner may be selected. Winners may be required to produce government-issued identification.

  1. PRIZES

There will be three (3) prizes awarded as part of this Contest.

One (1) Male Winner:

  •  The participant with the highest votes not ending in a tie score who picked the Male category for their submission will be selected as the potential “Male Prize Winner.”
  •  The Male Prize Winner will receive two (2) VIP passes that will give them entry into both the Nyctophobia Haunt as well as the Backroads Haunt including the front of the line benefit for each. The passes will admit the Male Prize Winner and one (1) companion into the Deathworkz Haunt Halloween Festival as well. Attraction passes are one time use.

One (1) Female Winner:

  •  The participant with the highest votes not ending in a tie score who picked the Female category for their submission will be selected as the potential “Female Prize Winner.”
  •  The Female Prize Winner will receive two (2) VIP passes that will give them entry into both the Nyctophobia Haunt as well as the Backroads Haunt including the front of the line benefit for each.  The passes will admit the Female Prize Winner and one (1) companion into the Deathworkz Haunt Halloween Festival as well. Attraction passes are one time use.

One (1) Squad Winner:

  •  The squad with the highest votes not ending in a tie score who picked the Squad category for their submission will be selected as the potential “Squad Prize Winner.”
  •  The Squad Prize Winner will receive four (4) VIP passes that will give them entry into both the Nyctophobia Haunt as well as the Backroads Haunt including the front of the line benefit for each.  The passes will admit each Squad Prize Winner into the Deathworkz Haunt Halloween Festival as well. Attraction passes are one time use.

 

  1. PRIZE CONDITIONS

Festival passes are subject to the Deathworkz Haunt Halloween Festival’s Ticketing Terms & Conditions and the issuer’s ticketholder agreement. Sponsor is not responsible if Festival is delayed, postponed or cancelled for any reason. Winner will not receive compensation from Sponsor for tickets that the winner is unable to use due to cancellation, postponement or delay of the Deathworkz Haunt Halloween Festival, but tickets may be subject to standard rain-check policies and procedures set by the issuer. Sponsor is not responsible for lost, misplaced or destroyed tickets. Prizes consist of only those items specifically listed as part of the prizes.  All travel related expenses for the Contest, including but not limited to, flights or other transportation to and from the Deathworkz Haunt Halloween Festival, lodging, food and beverage, taxes, insurance and incidentals are the sole responsibility of each Contest winner. Each winner and his or her companion(s) hereby agree that they will at all times comply with applicable laws, including but not limited to, alcohol (e.g., underage drinking laws) and illegal drug laws. Each winner and his or her companion(s) agree that they will conduct themselves at all times in a socially responsible, respectful and appropriate manner; and, should they fail to do so, the prize may be immediately terminated and the Sponsor may pursue other legal sanctions against such winner. No substitution, cash redemption or transfer of prize by winner is permitted, but Sponsor reserves the right to substitute a prize of equal or greater value.

  1. RELEASE

By participating in this Contest, participants agree to be bound by the Terms and the decisions of the Sponsor and the Judges. By participating in this Contest, participants hereby waive and release, and agree to hold harmless the Sponsor, the Judges, and their respective parents, subsidiaries, affiliates, distributors, licensors, advertising and promotion agencies, and all of their respective officers, directors, employees and representatives and agents (the “Released Parties”), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and/or property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of any prize, or their participation in this Contest, or any Contest or prize-related activity. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of any prize.

  1. OWNERSHIP & PUBLICITY

Participant represents and warrants he or she has the full right, title and interest to the Submission and/or a right and license from the owner of the Submission and that he or she will comply with all these Terms. By entering this Contest and providing a Submission, participant grants Sponsor and its respective parents, affiliates, subsidiaries, agents and licensees, the right to photograph, video and audio record winner’s performance in the Deathworkz Haunt Halloween Festival and a royalty-free, unconditional, irrevocable, and perpetual right, license and consent, without any compensation, consideration or further notification, to use, edit, reproduce, print, publish, display, transmit, distribute, sell, perform, adapt, enhance, or create derivative works from the DJ performance provided in connection with Submission, the DJ performance at the Deathworkz Haunt Halloween Festival and to use and refer to the participant, his or her name, likeness, image, distinctive characteristics, city, state, any statements made and prize information, for any purpose, including but not limited to, editorial, advertising, trade, commercial, and publicity purposes in any media throughout the world, unless prohibited by law. Sponsor also has the right to arrange for the news media and journalists to attend and, if applicable record, any public appearances and statements of the prize winner. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder.

  1. LIMITATION OF LIABILITY

Sponsor and their respective agencies are not responsible for lost, late, damaged, delayed, incomplete, illegible, or misdirected Submissions, Submissions not received by the entry deadline, or for electronic, network or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability to participate in this Contest, or other hardware, software or technical errors of any kind including any injury or damage to any person’s computer related to or resulting from participating in the Contest. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s Internet service provider and/or insufficient space in user’s e-mail account to receive e-mail. Sponsor reserves the right to cancel or modify the Contest (or any portion thereof) if fraud, misconduct or technical failures destroy the integrity of the Contest or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest, as determined by Sponsor, in their sole discretion. If the Contest is so cancelled, judging will be conducted from among all eligible Submissions received prior to the time of termination. In the event a dispute arises regarding a specific individual entitled to receive the prize, Submission will be declared made by the “authorized account holder” and any damage made to the website will also be the responsibility of the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Participant may be requested to provide Sponsor with proof that the participant is the authorized account holder of the e-mail address associated with the Submission. Proof of submitting a Submission will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods of participation will void all Submissions by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Terms.

  1. DISPUTES

Each participant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in the State of New York, (ii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees, and (iii) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, or the rights and obligations of participant and the Sponsor in connection with this Contest shall be governed by, and construed in accordance with the laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of New York or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of New York.

By entering the Contest, participants acknowledge that they are familiar with the provisions of California Civil Code Section 1452, which provides as follows:

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE WHICH IF KNOWN BY HIM MUST BE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.

Accordingly, by entering the Contest, participants (on their behalf and on behalf of their heirs, executors, administrators, personal representatives, predecessors, successors and assigns of any of the foregoing, and all other persons and entities asserting rights of or acting on behalf of the participant) hereby waive and relinquish any right or benefit which participant or such persons has, have or may have against Sponsor and their respective agencies under Section 1542 of the Civil Code of the State of California, or under any similar statutory or common law of any other jurisdiction to the full extent that any such person may lawfully waive such rights and benefits pertaining to the releases set forth in these Terms and Sponsor’s Privacy Policy.

  1. GENERAL TERMS

INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF THESE OFFICIAL RULES, AND MAY SUBJECT ANY PERSONS INVOLVED TO CRIMINAL AND CIVIL PROSECUTION, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW. The Contest is subject to all applicable federal, state and local laws and regulations.

  1. PRIVACY

By entering this Contest, participants give their express permission to be contacted by Sponsor by email or other contact information provided on the entry form. By participating in this Contest, participants acknowledge and agree that Sponsor may collect and use the personal information submitted by participant to administer this Contest and pursuant to Sponsor’s Privacy Policy.

  1. WINNER’S LIST

For name of winners, please send a self-addressed stamped envelope to Deathworkz LLC, 2404 St Charles Place, Modesto, CA 95350, ATTENTION: 2017 DWZ COSTUME CONTEST. Requests must be received no later than ninety (30) calendar days after winners are announced.
